Senate Bill No. 417 - Automated License Plate Readers

• Prohibits law enforcement agencies from retaining license plate data captured by automated license plate readers except under three specific circumstances: data obtained under a warrant, data relevant to an ongoing criminal investigation or fugitive/missing person location, or data retention requested by the vehicle's registered owner.

• Allows temporary retention of captured plate data for up to 24 hours if comparison with alert databases indicates potential relevance to criminal investigations, missing persons, fugitives, or crimes, to allow time for investigation and verification.

• Designates captured plate data as confidential and prohibits transfer or sale to other persons, except for exchange between law enforcement agencies when the data may be lawfully retained.

• Defines "automated license plate reader" as a system of mobile or fixed high-speed cameras with computer algorithms to convert license plate images into computer-readable data, excluding toll collection devices.

• Becomes effective on July 1, 2014.
