HEA 1036 Summary

• Removes the requirement for general assembly statutory authorization to construct Interstate Highway 69 in Perry Township (Marion County), which had a population between 100,000 and 110,000 in a consolidated city county, effective July 1, 2015.

• Maintains requirement for general assembly statutory authorization to impose tolls on Interstate Highway 69 and on nontolled highways, roadways, or facilities existing or under construction as of July 1, 2011.

• Exempts four categories of transportation projects from requiring general assembly authorization during the period July 1, 2011 through June 30, 2021: projects beginning construction after June 30, 2011 (except I-69 except as specified), addition of toll lanes to existing facilities, the Illiana Expressway, and projects connecting Indiana with Kentucky within metropolitan planning areas.

• Makes conforming amendments across multiple Indiana Code sections governing toll road authorities, public-private agreements, and department of transportation powers related to toll roads and arterial highways.
