AI Summary

  • Authorizes the alcohol and tobacco commission to issue a supplemental package liquor store permit to beer dealers who own package liquor stores, allowing them to fill and sell beer in refillable containers up to 128 ounces.

  • Permit holders may fill containers by transferring beer from brewery-sealed kegs and sell the filled containers to consumers for off-premises consumption; containers may be provided by consumers or sold by the permit holder.

  • Containers cannot be filled before the sale is completed, and permit holders must comply with labeling and sealing requirements; activities are limited to licensed premises during authorized dealer hours.

  • Initial permit fee is $10,000 per package liquor store location with annual renewal fees of $1,000; proprietors with multiple locations must obtain separate permits for each location.

  • Exempts supplemental permit holders from existing statutes prohibiting the refilling of alcoholic beverage containers and the sale of beer in non-brewer-packaged containers; all collected fees deposit into the alcohol and tobacco commission enforcement and administration fund.
