AI Summary

  • Beginning July 1, 2016, any food offered for retail sale that is entirely or partially produced with genetic engineering must be clearly labeled as "Genetically Engineered" (raw agricultural commodities) or "Partially Produced With Genetic Engineering" or "May Be Partially Produced With Genetic Engineering" (processed foods).

  • Prohibits labeling or advertising genetically engineered or processed foods with terms such as "natural," "naturally made," "naturally grown," or "all natural" beginning July 1, 2016.

  • Exempts from labeling requirements: non-genetically engineered animals regardless of feed, certain segregated non-engineered commodities with sworn statements, genetically engineered processing aids or enzymes, alcoholic beverages, foods with minimal engineered ingredients (until July 1, 2021), certified organic foods, foods served in restaurants, and medical foods.

  • Violations constitute Class A infractions, and the state department of health shall administer and enforce the chapter; allows the state department or any person to bring civil actions to enjoin violations with court costs and attorney's fees awarded to prevailing parties.

  • The chapter does not require individual ingredient identification as genetically engineered or placement of the term immediately preceding a food's common name.
