HB 1528 Summary

• Adds definition of "professional license" as any license, certificate, registration, or permit issued by a board under IC 25.

• Grants persons seeking judicial review of a final agency determination to revoke a professional license the right to a jury trial, with jury selection and qualification governed by civil action rules.

• Requires that a demand for jury trial be included in the petition for review; failure to include this demand constitutes a waiver of the right to jury trial.

• Excludes the right to jury trial for persons seeking judicial review of nonfinal agency actions or emergency suspensions involving professional licenses.

• Permits juries conducting judicial review to determine facts de novo from evidence presented, but restricts new evidence to testimony and materials that were presented during the agency action (with limited exceptions).

• Takes effect July 1, 2015.
