IN HB1559

Establishes the Office of the Special Prosecutor for Civilian and Police Affairs with a chief prosecutor appointed by the governor to investigate all incidents where law enforcement officers kill or seriously injure another person.

Creates a statewide special prosecuting attorney pool of at least 10 qualified prosecutors appointed by the governor from geographically diverse counties; the chief must randomly select a prosecutor from this pool within 10 days when jurisdiction vests, excluding those with conflicts of interest.

Grants the Office exclusive jurisdiction to prosecute law enforcement officers who kill or cause serious bodily injury to unarmed persons, divesting local prosecuting attorneys of such cases.

Establishes the Police Conduct Review Commission with 13 members (including legislators, governors appointees, law school professors, and law enforcement officials) to investigate incidents involving police violence against unarmed persons and recommend appointment of special prosecutors by majority vote.

Effective July 1, 2015; expenses paid from state general fund; investigation reports are confidential unless governor declares otherwise; investigative teams provided by Indiana State Police or other agencies as designated by governor.
