Senate Enrolled Act 168 Summary

• Amends IC 35-48-7-11.1 to permit individuals holding a valid temporary medical permit under IC 25-22.5-5-4 or IC 25-22.5-5-4.6 to access confidential INSPECT program information.

• Maintains confidentiality protections for INSPECT prescription drug monitoring data while establishing approved recipients including law enforcement, prosecutors, practitioners, and controlled substance monitoring programs.

• Limits information disclosed to law enforcement under subsection (d)(3) to cases involving unlawful diversion or misuse of Schedule II, III, IV, or V controlled substances.

• Requires board approval before releasing confidential information and mandates peer review by a board member licensed in the same profession as the identified practitioner before releasing data on high-volume prescribers.

• Provides civil and criminal immunity protections for practitioners who in good faith seek or disclose INSPECT information, except in cases of gross negligence or intentional misconduct.

• Effective July 1, 2015.
