Adds new subsection (i) to IC 22-4-13-1 requiring the department of workforce development to waive repayment of unemployment benefit overpayments if benefits were received without fault and resulted from a department error, including individuals employed by employers making payments in lieu of contributions.

Maintains existing waiver provisions in subsection (h) allowing waiver of overpayment repayment upon individual request if benefits were received without fault, resulted from appeal payments or employer/department error, and repayment would cause economic hardship.

Amends IC 22-4-13-4 to clarify that individuals not subject to waiver under the new subsection (i) may repay overpayments exceeding four times their weekly benefit amount over a period not to exceed 36 months, only once during their lifetime.

Establishes that department errors triggering the mandatory waiver include any administrative mistakes made by the department, removing the requirement to prove economic hardship in such cases.

Effective date: July 1, 2015.
