Senate Bill No. 198 Summary

• Repeals IC 5-16-7, the common construction wage statute, effective July 1, 2015.

• Creates new chapter IC 5-16-7.1 to preserve application of the common construction wage statute for public works contracts awarded before July 1, 2015.

• Removes common construction wage requirements from multiple statutes including those governing BOT agreements, operating improvement boards, design-build contracts, and economic development commissions.

• Makes conforming amendments to approximately 30 Indiana Code sections to remove references to the repealed common construction wage statute or renumber related provisions.

• Maintains common construction wage requirements for specific projects including the Illiana Expressway and certain public-private agreements entered into after April 30, 2011.
