Senate Bill 377 Summary

• Abolishes the grand jury system in Indiana, effective July 1, 2015

• Transfers grand jury functions to prosecuting attorneys, who will handle affidavits and evidence that would have been presented to grand juries

• Amends numerous Indiana Code citations to replace references to grand juries with prosecuting attorney authority in election law violations, criminal investigations, and other proceedings

• Repeals the entire grand jury statute (IC 35-34-2) and makes conforming amendments throughout the Indiana Code

• Changes criminal procedure to allow charges to be brought by information filed by the prosecuting attorney instead of by grand jury indictment
