HEA 1013 Summary

• Law enforcement agencies must obtain a search warrant to use unmanned aerial vehicles, except in cases of exigent circumstances, terrorist threats, search and rescue operations, disaster response, non-criminal surveys, motor vehicle accident documentation, or with property owner consent.

• Electronic communications service providers must provide geolocation information to law enforcement upon request to respond to emergency calls or in emergency situations involving risk of death or serious bodily injury, without requiring a prior search warrant if obtaining one would cause unreasonable delay.

• Law enforcement agencies requesting geolocation information without a warrant must seek a judicial order based on probable cause within 72 hours of the initial request.

• Service providers and their officers, employees, and agents are granted civil liability protection for providing geolocation information in compliance with these provisions or for communications service disruptions during emergencies.

• Electronic communications service providers must submit emergency contact information to the Indiana State Police Department annually by January 1 and immediately upon any changes, with the State Police maintaining and making this information available to all state and local law enforcement agencies.
