Beginning July 1, 2017, any food offered for retail sale must disclose if it was or may have been produced with genetic engineering, or it is considered misbranded under Indiana food law.

Raw agricultural commodities must display "Genetically Engineered" in clear and conspicuous words on the front of the package, or on a retail shelf label if not separately packaged.

Processed foods must display "Partially Produced With Genetic Engineering" or "May Be Partially Produced With Genetic Engineering" in clear and conspicuous language on the front or back of the package.

Food labels, retail signs, and advertising materials cannot claim a genetically engineered or processed food is "natural," "naturally made," "naturally grown," or "all natural."

Violations are Class A infractions; the state department of health administers and enforces the law; the state department or any person may bring civil action to enjoin violations and recover court costs and attorney's fees.

Exemptions apply to animal products not genetically engineered, organic certified foods, alcoholic beverages, certain processed foods with minimal genetically engineered ingredients until July 1, 2021, and foods prepared for immediate consumption in restaurants.
