IN HB1140

Adds definitions for "amusement ride operator," "owner," "regulated amusement device," and "rider" to Indiana Code IC 34-6-2 and establishes a new chapter IC 34-31-11.6 for limited liability protections.

Requires amusement ride operators and owners to post rider duties and owner duties/obligations in a conspicuous location, maintain safety equipment legibility, keep devices in good mechanical condition, and comply with all applicable fire, building, and safety codes.

Establishes that riders must heed all posted signs and verbal instructions, refrain from tampering with safety devices, and avoid actions that may injure themselves or others.

Provides a complete defense against injury lawsuits for operators and owners if riders fail to comply with their duties, except when the operator or owner violates their own statutory duties under the chapter.

Effective July 1, 2016; amends IC 34-6-2 and creates new chapter IC 34-31-11.6 concerning civil procedure.
