HEA 1199 Summary

• Adds "promotion of human trafficking of a minor" under IC 35-42-3.5-1(b)(1)(B) or IC 35-42-3.5-1(b)(2) to the definition of "sex offender" for registration purposes, effective July 1, 2016.

• Adds "promotion of human trafficking of a minor" and "murder" and "voluntary manslaughter" to the definition of "sex or violent offender" for registration purposes, effective July 1, 2016.

• Renumbers subsequent offenses in both "sex offender" and "sex or violent offender" definitions to accommodate the new crimes added to the lists.

• Maintains existing exceptions for sexual misconduct with a minor convictions where the offender is no more than 4 years older than the victim (for crimes after June 30, 2007) or 5 years older (for crimes before July 1, 2007) and the court finds registration should not be required.

• Applies to both adults convicted of these crimes and to juveniles at least 14 years old who are found by clear and convincing evidence to be likely to repeat such offenses.
