HB 1216 Summary

• Amends Indiana Code IC 35-42-2-9 to add application of pressure to a victim's torso as a strangulation offense element, in addition to existing provisions covering throat/neck pressure and nose/mouth obstruction.

• Defines "torso" as any part of the upper body from the collarbone to the hips for purposes of the strangulation statute.

• Establishes strangulation as a Level 6 felony when committed in a rude, angry, or insolent manner and impedes normal breathing or blood circulation.

• Elevates strangulation to a Level 5 felony if the offense is knowingly committed against a pregnant woman and the offender knew the victim was pregnant at the time of the offense.

• Effective July 1, 2016.
