AI Summary

Senate Bill No. 33 Summary

  • Requires retail establishments with employee toilet facilities to allow customer access upon request during normal business hours if the customer has an eligible medical condition (Crohn's disease, ulcerative colitis, inflammatory bowel disease, irritable bowel syndrome, or other conditions requiring immediate toilet access) or uses an ostomy device.

  • Establishes six conditions that must be met for access: facility is reasonably safe, customer has eligible condition or uses ostomy device, at least 3 employees are working, establishment doesn't normally open restroom to public, access creates no obvious health/safety/security risk, and no public restroom is immediately accessible.

  • Makes it a Class C infraction to deny access when all conditions are met, with civil judgment limited to a maximum of $100.

  • Provides immunity from civil liability for owners, operators, and employees for acts or omissions in allowing facility use if the act is not willful or grossly negligent and occurs in a non-public area, even if injury or death results.

  • Does not require retail establishments to make any physical changes to employee toilet facilities.

  • Effective July 1, 2016.
