HB 1300 Summary

  • Allows investor-owned utilities to furnish electric, gas, water, or wastewater service at free or reduced rates to customers locating in incentive areas (economic development zones, enterprise zones, tax increment financing districts, or similar areas) when a political subdivision dedicates funds for utility infrastructure in that area.

  • Requires utilities to file a new rate schedule with both the political subdivision and the Indiana Utility Regulatory Commission at least 60 days before the reduced rates take effect; the commission must approve the new schedule.

  • Exempts rate changes for incentive areas from being treated as general rate increases and exempts them from standard rate proceeding requirements and notice/hearing provisions.

  • Protects utilities offering free or reduced rates in incentive areas from violating state law prohibitions against charging different rates for similar services to different customers.

  • Protects customers receiving free or reduced utility service in incentive areas from violating state law prohibitions against knowingly soliciting or accepting reduced-rate utility service.

  • Effective July 1, 2017.
