HB 1398 Summary

• Creates new offense of "making a terroristic threat," a Level 5 felony, for threatening a public safety official or their spouse, child, or parent with intent to place them in fear or knowing the threat will place them in fear

• Defines "terroristic threat" to include expressions relating to causing physical injury, damaging property, unlawful confinement, or committing a crime against a public safety official or their family members

• Makes it not a defense that the defendant did not threaten a specific individual

• Updates definitions of "public safety official," "communicates," and "threat" in Indiana Code to align with new terroristic threat provisions

• Effective July 1, 2017
