HB 1409 Summary

• Removes requirement that advanced practice nurses have a practice agreement with a collaborating physician, effective July 1, 2017.

• Repeals IC 25-23-1-19.8, which required random audits of at least 1-10% of advanced practice nurse practice agreements by the Indiana professional licensing agency.

• Repeals IC 34-30-2-99.4, which provided immunity for licensed practitioners who released patient health records to the professional licensing agency for audits.

• Modifies definitions of "physician's authorized representative" in IC 16-41-6-1 to remove requirement that advanced practice nurses operate "in collaboration" with a licensed physician for HIV testing authority.

• Makes conforming changes to remove practice agreement references from prescriptive authority requirements and mental health service reimbursement provisions for advanced practice nurses employed by community mental health centers.
