HB 1069 Summary

  • School corporations and municipalities that install net metering facilities between December 31, 2017 and the net metering tariff termination date and are subject to Level 2 interconnection review can continue receiving net metering service until July 1, 2037 or facility removal, whichever occurs first.

  • All other customers installing net metering facilities during the same period can continue receiving net metering service until July 1, 2032 or facility removal, whichever occurs first.

  • Successors in interest to properties with qualifying net metering facilities may optionally continue receiving net metering service under the same terms and timelines as the original customer.

  • Defines "install" as setting up a system for safe energization regardless of metering or inspection requirements; "nameplate capacity" as the full-load continuous rating or aggregate inverter output; and "successor in interest" as a person or entity following another in property ownership or control.

  • Repairs, updates, and upgrades that do not increase nameplate capacity are not considered facility replacements; only nameplate capacity in place before statutory deadlines participates in the net metering tariff.
