HEA 1140 Summary

• Effective July 1, 2018, cities and towns can enter interlocal agreements under IC 36-1-7 to share court jurisdiction for ordinance violations with municipalities in the same judicial circuit or county.

• Expands county authority to enter interlocal agreements with cities or towns to use their ordinance violations bureaus or courts for handling county ordinance violations.

• Civil penalties collected from ordinance violations under interlocal agreements must be accounted for and distributed according to terms specified in each agreement.

• Clarifies jurisdiction of city courts and town courts to handle misdemeanors, infractions, and ordinance violations referred through valid interlocal agreements.
