HB 1212 Summary

• Amends Indiana Code 35-43-2-2 to authorize property owners to use purple marks as a legal method to post property against trespassers, effective July 1, 2018.

• Purple marks on trees must be vertical lines at least 8 inches long, positioned 3-5 feet from the ground, and spaced no more than 100 feet apart.

• Purple marks on posts must cover at least the top 2 inches, positioned 3-5.5 feet from the ground, and spaced no more than 36 feet apart.

• All owners or lessees must agree before applying purple marks visible from both sides of a shared fence between different properties.

• Purple marks constitute valid notice of denied entry under criminal trespass law, joining existing methods such as personal communication, posted notices at main entrances, and court orders.
