Indiana House of Representatives states that the American Law Institute's Restatement of the Law, Liability Insurance approved at the 2018 annual meeting does not reflect Indiana's public policy and is not a faithful statement of existing Indiana law.

Resolution asserts the Restatement is not an appropriate subject of notice and should not be afforded recognition by courts as an authoritative reference regarding established rules and principles of insurance law.

Resolution notes that several significant matters in the Restatement are inconsistent with established law in Indiana and other states, potentially causing confused and conflicting application of law to insurers and policyholders.

The National Conference of Insurance Legislators' Executive Committee adopted a resolution on January 5, 2018 communicating concerns about the Restatement's inconsistencies and potential for harm to the American Law Institute.

Principal Clerk of the House of Representatives shall transmit a copy of this resolution to State Representative Matt Lehman's office for distribution.
