Municipalities may annex land on both sides of railroad tracks as a single contiguous territory, even when the tracks separate parcels that would not otherwise meet contiguity requirements under IC 36-4-3-1.5

No consent is required from railroad owners, lessees, operators, or users to annex territory across their tracks and right-of-way

The railroad tracks and right-of-way themselves cannot be annexed under this provision—only the land on either side
