INDOT commissioner may award road construction, improvement, or maintenance contracts to bidders other than the lowest bidder if the bidder commits to employing at least 65% Indiana residents (defined as living in Indiana for 12+ consecutive months)

Non-lowest bids may be accepted only if within 5% of the lowest bid amount and not exceeding the project's estimated cost

Bidders must participate in a U.S. Department of Labor-recognized apprenticeship program and verify all workers' employment eligibility through E-Verify

Contractors must prohibit use of independent contractors on the project and submit certified payroll reports demonstrating compliance with wage and labor standards

Effective July 1, 2026; amends IC 8-23-9 by adding new section 4.7
