Retailers selling low THC hemp extract containing delta-8 THC, delta-10 THC, HHC, THCo, THCA, THCp, or THCv must prohibit individuals under 21 from entering the retail premises and post conspicuous warning signs at every entrance

Violations constitute a Class C infraction with escalating penalties based on prior violations at the same location: up to $400 for first offense, $800 for second, $1,400 for third, and $2,000 for four or more violations within one year

Retailers have defenses available if the underage individual presented a valid photo ID showing age 21+, appeared to be at least 30 years old, or was delivering goods as part of their employment

Pharmacies and health care facilities are exempt and may sell low THC hemp extract to individuals 21 and older without the entry restrictions
