IN HB1320

Removes language allowing law enforcement officers to use an affidavit from a witness with direct knowledge to establish probable cause for battery and domestic battery arrests

Requires the Office of Judicial Administration to provide protection order forms to every law enforcement agency with jurisdiction in each county

Mandates that law enforcement officers who provide protection order forms to domestic battery or harassment victims must remain with the victim while completing the forms and file the completed forms with the appropriate court as soon as practicable, unless the victim refuses assistance

Clarifies that clerical assistance provided by law enforcement officers in completing protection order forms does not constitute the practice of law

Effective July 1, 2026
