Towns may annex noncontiguous residential developments with at least 50 single-family lots and 60 multi-family lots located between 1.6 and 2.6 miles from town boundaries, along with the connecting state highway right-of-way

Annexation requires the residential development owner to petition the town, followed by town legislative body approval within 60 days, adoption of a fiscal plan, and a public hearing with 30 days notice

Annexed developments must connect to town water service and either town sewer or a regional sewer district, and must include a commercial area

Territory annexed under this process cannot be used as a basis for annexing additional contiguous territory under standard annexation procedures (sections 3 or 4)

No remonstrance may be filed against annexations where all property owners petition for annexation; the ordinance takes effect at least 30 days after publication
