Eliminates eminent domain authority for acquiring right-of-way to construct or operate pipelines primarily transporting carbon dioxide or other carbon oxides

Prohibits use of eminent domain to acquire underground strata or formations for Class VI injection wells or EPA-required monitoring facilities for carbon dioxide storage

Removes eminent domain power for carbon sequestration pilot projects and other underground carbon dioxide storage projects

Repeals existing law declaring carbon dioxide pipelines and underground carbon storage to be a "public use" in the public interest

Effective date: July 1, 2026
