Legislative bodies of second or third class cities and towns may petition a court to remove fiscal officers for charging illegal fees, failing to perform duties, failing to be physically present in office, or missing four consecutive legislative body meetings

Removal requires the legislative body to adopt a resolution by majority vote after holding at least one public hearing with at least 10 business days notice

Legislative bodies must establish policies defining reasonable physical presence requirements and circumstances for approved hybrid/remote work or off-site official duties

Defenses against removal for office absence include serious illness of the officer or immediate family members, military service, or local disaster emergency declarations

If charges are sustained, the court removes the officer from office and enters judgment for $500 to the prosecuting officer plus costs and repayment of compensation received from accusation filing to judgment; effective July 1, 2026
