IN HB1391

Knowingly or intentionally using a telecommunications device while operating a moving motor vehicle becomes a Level 5 felony if the violation causes serious bodily injury to another person

Offense elevates to a Level 4 felony if the driver has a previous telecommunications device infraction within the preceding 5 years

Each person injured constitutes a separate criminal offense, allowing multiple charges from a single incident
