IN HB1402

Increases the minimum distance requirement for tobacco and vaping businesses from schools from 1,000 feet to 3,520 feet, measured from the nearest point of the business premises to the nearest school building used for instruction

Applies to both public and private elementary and secondary schools, as well as school property generally

Grandfathers existing tobacco and vaping businesses operating before July 1, 2026, exempting them from the new distance requirements

Also exempts businesses that opened after June 30, 2026 if they were compliant with distance requirements at the time they began operating

Violations constitute a Class C misdemeanor; effective date is July 1, 2026
