Towns, cities, and counties may establish or designate local air pollution control agencies to enforce air pollution ordinances and undertake pollution control activities on behalf of the Indiana Department of Environmental Management

The IDEM commissioner must enter into contracts with willing local agencies, providing technical assistance and authorizing activities such as air quality monitoring, issuing operating permits, conducting compliance inspections, and initiating enforcement actions

Local agencies must receive fair monetary compensation sufficient to cover staffing and operating costs, funded through EPA grants under Clean Air Act Sections 103 and 105, annual operating fees, and the environmental management special fund

Compensation rates must be adjusted annually within 30 days of the January CPI-U release, proportional to year-over-year changes in the Consumer Price Index for All Urban Consumers

Effective July 1, 2026
