After December 31, 2025, local permit authorities cannot establish zoning overlay districts for commercial solar energy projects unless all underlying zoning districts already permit solar project development under existing ordinances

Underlying zoning districts that do not currently allow commercial solar projects must first be formally rezoned through the standard rezoning process before an overlay district can be created

Commercial solar energy systems are defined as facilities that capture and convert solar energy into electricity for wholesale sale and off-site use, including panels, substations, tie lines, and ancillary equipment

Residential solar devices installed on a property owner's premises for on-site heating, cooling, or electrical needs are explicitly excluded from these requirements

Overlay districts established before January 1, 2026 are grandfathered and not subject to these new restrictions; the bill takes effect January 1, 2026 retroactively with an emergency declaration
