Creates a new wholesale tobacco sales certificate requirement for persons selling tobacco products or electronic cigarettes at wholesale, with a $100 application fee, separate from the existing $200 retail tobacco sales certificate

Prohibits the sale, possession, or distribution of "foreign adversary products" (e-liquids or e-liquid products manufactured by, sourced from, or imported from nations listed as foreign adversaries in 15 CFR 791.4, such as China), unless FDA-approved or pending FDA review

Increases e-liquid manufacturing permit fees from $1,000 to $3,000 for initial applications and from $500 to $1,000 for renewals, while reducing permit validity from 5 years to 2 years for permits issued after June 30, 2026

Establishes escalating certificate suspension penalties for tobacco sales certificate holders whose employees violate identification requirements: 5-day suspension for 3 violations, additional suspensions for 4-5 violations, and revocation for 6 or more violations within one year

Lowers the threshold for "habitual illegal sale of tobacco" from 6 violations to 3 violations in one year, and adds sale of alcohol without a permit to the list of racketeering activities
