Prohibits drivers from physically holding electronic communication devices, texting, making calls, watching videos, or recording/broadcasting video while operating a motor vehicle on public roadways

Exempts hands-free/voice-operated device use for non-commercial vehicles, navigation and audio access, emergency reporting, law enforcement on duty, and vehicles that are lawfully stopped or parked

Imposes escalating fines: $150 for first offense, $250 for second offense within two years, $500 for third and subsequent offenses; $500 mandatory fine for violations in school zones or active construction zones

Creates enhanced criminal penalties when violations cause property damage over $5,000 (class B misdemeanor), great bodily harm (class A misdemeanor), or death (severity level 6 person felony)

Establishes warning-only period from effective date through January 1, 2026; prohibits stops solely for this violation and requires officers to inform drivers of their right to decline device searches
