All Kansas law enforcement agencies must apply to enter into 287(g) agreements with U.S. Immigration and Customs Enforcement under 8 U.S.C. § 1357(g) to authorize designated officers to assist in enforcing federal immigration laws

Agencies that fail to secure an agreement must submit written documentation to the attorney general proving they applied but were not offered an agreement by ICE

Non-compliant agencies have 30 days to comply after receiving written notice from the attorney general, who may then file suit in Shawnee County district court seeking injunctive relief and attorney fees

Agencies found non-compliant by final court judgment lose eligibility for all unpaid state grant moneys and cannot receive state grants during the following fiscal year

Applies to city police departments, county sheriff's departments, county law enforcement departments, and other law enforcement departments of taxing political subdivisions
