Expands Kansas criminal use of a financial card statute (K.S.A. 21-5828) to include gift cards, making it illegal to acquire or retain possession of a gift card or gift card redemption information without consent, or to alter or tamper with a gift card

Establishes penalties based on value obtained within a seven-day period: severity level 7 nonperson felony for $25,000 or more, severity level 9 nonperson felony for $1,000 to under $25,000, and class A nonperson misdemeanor for under $1,000

Defines key terms including "closed-loop gift card" (redeemable at single merchant or affiliated merchants) and "open-loop gift card" (redeemable at multiple unaffiliated merchants within a payment network)

Covers both physical and digital gift cards, whether activated or inactivated, and includes gift card issuers, sellers, and redemption information in the statutory definitions

Takes effect upon publication in the Kansas Register
