All firearm sales, exchanges, and transfers in Kentucky must include a national instant background check conducted by a consenting licensed dealer, with exceptions for transactions by licensed dealers acting under their federal license and transfers between immediate family members (spouses, parents, children, stepchildren)

Dealers must complete a Kentucky State Police-developed form confirming the background check was performed, maintain records of all transactions on their licensed premises, and make records available for inspection by peace officers during reasonable hours

Dealers may charge a fee of up to $10 per transaction for conducting background checks

Records produced under this section are exempt from the Kentucky Open Records Act and not considered public records

Knowingly violating the background check requirements is a Class A misdemeanor
