Amends KRS 532.025 to add a new statutory aggravating circumstance for death penalty cases: when the offender abused the corpse of a kidnapping or murder victim by engaging in deviate sexual intercourse, sexual intercourse, or sexual contact as defined in KRS 510.010

Applies to sentencing hearings in capital cases where the death penalty may be imposed, allowing judges and juries to consider this new aggravating factor alongside existing circumstances

Existing aggravating circumstances include prior capital offense convictions, murder during commission of other felonies, multiple deaths, killing children under 12, and killing public officials or first responders

Finding at least one statutory aggravating circumstance beyond a reasonable doubt is required before imposing the death penalty or life without parole
