Multi-unit dwellings (structures with more than 2 separate dwelling units) and mixed-use developments must be allowed as permitted uses in all commercial zones throughout Kentucky

Mixed-use developments are defined as projects where nonresidential uses comprise less than 50% of total square footage and are limited to the first floor of buildings with 2 or more stories

Planning units are prohibited from adopting regulations that ban multi-unit dwellings or mixed-use developments in commercial zones

Requirements imposed on multi-unit dwellings or mixed-use developments cannot be more restrictive than those placed on other uses within the same commercial zone

Parking requirements are capped at a maximum of 1 off-street parking space per unit, plus ADA-required accessible spaces
