Amends KRS 454.460 to add a new definition of "filed in bad faith" meaning presenting pleadings, motions, or papers for improper purposes such as harassment, causing unnecessary delay, or needlessly increasing litigation costs

Excludes from "bad faith" claims that are well grounded in fact and warranted by existing law, or good-faith arguments for changing existing law

Adds new definition of "goods or services" that excludes dramatic, literary, musical, political, journalistic, or artistic works

Modifies fee-shifting provisions in KRS 454.478 for anti-SLAPP motions: courts must award costs, attorney's fees, and litigation expenses to the prevailing moving party only if the responding party's claim was filed in bad faith

Changes standard for awarding fees to responding parties who defeat anti-SLAPP motions from "without good cause" to "filed in bad faith," making it harder for plaintiffs to recover costs when they successfully resist dismissal
