Employers with 75 or more employees are prohibited from demoting, dismissing, disciplining, or discriminating against employees who are candidates for, currently serving in, or elected to the Kentucky General Assembly or local government legislative bodies

Employees elected or appointed to covered legislative offices may request a leave of absence that employers must grant, which may be paid or unpaid and cannot exceed 3 terms for House members, 2 terms for Senate members, or 2 terms for local legislative positions

Leave of absence provisions do not prevent employees from working and being compensated during the leave period, nor do they impair employee seniority rights

Employers who violate these protections face civil penalties of $100 to $1,000 per offense

Aggrieved individuals may seek injunctive relief and recover damages, costs, and reasonable attorney fees through court action
