Creates a new risk protection order process allowing courts to prohibit individuals from purchasing, possessing, or controlling firearms when clear and convincing evidence shows a diagnosed or treated mental condition causes impairment presenting an unreasonable risk to public safety

Petitions may be filed in District Court by mental health professionals, peace officers, attorneys, spouses, relatives, friends, guardians, or other interested persons, with hearings required within 14 days

Orders must be entered into the Law Information Network of Kentucky within 24 hours and reported to the National Instant Criminal Background Check System for background checks

Violation of a risk protection order constitutes a Class A misdemeanor, and firearms possessed in violation are subject to forfeiture

Amends KRS 237.104 to add risk protection order violations as an exception to restrictions on government seizure of firearms during emergencies; may be cited as "Diego's Law"
