Racing facilities that were lawfully constructed before surrounding property owners purchased or built on their land are granted immunity from nuisance and taking lawsuits filed by those property owners

"Area of the racing facility" is defined as within a 5-mile radius of the property perimeter where the facility is located

Immunity applies regardless of changes to the facility's size, scope, configuration, technology, or type of racing conducted, as long as changes comply with applicable laws

Declared an emergency measure, taking effect immediately upon the Governor's approval, citing racing facilities' contributions to amusement, recreation, and economic development in Kentucky communities
