Kentucky criminal justice agencies must provide criminal history records to federal agencies (including Department of Defense, CIA, FBI, Homeland Security, and others) conducting background investigations for federal or contractor employee suitability and fitness assessments under 5 U.S.C. sec. 9101

Criminal justice agencies may charge a $25 fee to requesting federal agencies for providing records, but Kentucky state agencies are prohibited from paying this fee

Juvenile court record confidentiality provisions are exempted for criminal justice agencies conducting federal employee background checks, allowing access to otherwise sealed records

Criminal history records information includes arrests, indictments, charges, dispositions, sentencing, and corrections supervision—including sealed records accessible for background check purposes

Criminal justice agencies covered include Kentucky State Police, sheriffs, local police departments, correctional facilities, school resource officers, and airport security departments
