Public contracts for foundation construction or maintenance of public buildings and works made after August 1, 2026, must require iron, steel, and aluminum to be manufactured in the United States

Waivers may be granted if: the requirement is inconsistent with public interest, materials are not available domestically in sufficient quantities or quality, or U.S.-made materials would increase contract costs by more than 10%

Waiver requests must be filed at least 30 days before bid opening, with public notice and comment period of at least 20 days before bids open

Persons found by a court or agency to have intentionally mislabeled materials as "Made in America" or misrepresented materials as U.S.-manufactured will be debarred from government contracts

Requirements apply to state agencies, cities, counties, special districts, school districts, public universities, and the Transportation Cabinet (may be cited as the "Kentucky Buy American Act")
