Requires the Cabinet for Health and Family Services to submit a waiver amendment application to federal CMS within 90 days to add assisted living services coverage to Kentucky's 1915(c) Home and Community Based (HCB) waiver program

Limits assisted living coverage to HCB waiver participants who are 65 years or older, ambulatory, at risk of nursing facility admission according to a physician, and residing in a cabinet-licensed assisted living community

Excludes room and board costs from covered assisted living services, consistent with federal law requirements

Mandates the cabinet promulgate administrative regulations within 90 days of federal approval, including provider qualifications, reimbursement rates, and maximum room and board rates assisted living communities may charge participants

Renders the entire section void if the federal Centers for Medicare and Medicaid Services denies the waiver amendment application
