Local boards of education may authorize student-based enterprises to sell competitive foods throughout the school day, creating an exception to the current ban on competitive food sales from student arrival until 30 minutes after the last lunch period.

"Student-based enterprise" is defined as a district-approved program operated by students as part of a course designed to provide knowledge and experience in business operations.

Local boards may establish policies governing the operation of student-based enterprises and the use of proceeds generated from these enterprises.

Student-based enterprises are exempt from penalties that apply to other competitive food sale violations, which include fines of one week's revenue for first violations and one month's revenue for subsequent violations.
