Prohibits pretrial release (including own recognizance, bail, or administrative release) for any person who cannot provide proof of U.S. citizenship or lawful immigration status

Requires law enforcement agencies, jails, and regional jails to immediately notify the U.S. Department of Homeland Security when a person in custody cannot prove citizenship or lawful presence to determine immigration status and any ICE detainer

Limits detention under these provisions to 48 hours maximum, after which the person becomes eligible for standard pretrial release options

Mandates that pretrial risk assessments consider inability to prove citizenship or lawful status as a factor when evaluating flight risk, likelihood to appear for trial, and potential danger to the public
